Terms and Conditions Services

Article 1 - Definitions

1.1. Wake Beyond Consciousness: The company offering services via www.wakebeyondconsciousness.com, located in Strijp-S | Eindhoven | NL, registered with the Chamber of Commerce (KVK) under number 96085835.

1.2. Client: The natural person or legal entity using the services of Wake Beyond Consciousness.

1.3. Services: All activities offered by Wake Beyond Consciousness, including but not limited to the Blind Spot Program and the Lasting Change Program. These services are offered exclusively online.

1.4. Agreement: The arrangement between Wake Beyond Consciousness and the Client for the provision of Services, recorded in writing or electronically (e.g., via email, website form, or agreement).

Article 2 - Applicability

2.1. These terms and conditions apply to all offers, agreements, and Services of Wake Beyond Consciousness, unless otherwise agreed in writing.

2.2. Deviations from these terms are only valid if explicitly agreed upon in writing.

2.3. If any provision of these terms is invalid or voidable, the remaining provisions shall remain in full force and effect.

Article 3 - Offer and Agreement

3.1. All offers from Wake Beyond Consciousness are non-binding unless stated otherwise.

3.2. An Agreement is concluded as soon as the Client accepts the offer (e.g., via registration, payment, or written confirmation) and Wake Beyond Consciousness has confirmed this.

3.3. Wake Beyond Consciousness reserves the right to refuse registrations without stating a reason.

Article 4 - Execution of Services

4.1. Wake Beyond Consciousness performs the Services with due care and to the best of its ability, in accordance with the agreed content of the Agreement.

4.2. The Services focus on personal development with an energetic and practical approach. Results depend on the Client’s commitment and circumstances; therefore, Wake Beyond Consciousness cannot guarantee specific outcomes.

4.3. Wake Beyond Consciousness reserves the right to adjust the content, location, date, or format of the Services (e.g., from online to in-person) if circumstances require this, such as unforeseen events or insufficient registrations for group sessions. The Client will be informed in a timely manner.

4.4. The Client must provide all necessary information in a timely manner for proper execution of the Services. Failing this, Wake Beyond Consciousness may suspend execution.

Article 5 - Prices and payment

5.1. All prices are in euros and include VAT unless stated otherwise.

5.2. Payment must be made within the term stated in the invoice or offer, or at the latest before the start of the Service, via the indicated payment method.

5.3. In case of late payment, Wake Beyond Consciousness may suspend access to the Services or terminate the Agreement, without prejudice to the right to compensation.

5.4. Price increases due to unforeseen circumstances (e.g., increased costs) will be communicated as soon as possible. This does not affect existing Agreements.

Article 6 - Cancellation and Refunds

6.1. For distance agreements (e.g., online Services), the Client has a 14-day right of withdrawal in accordance with the law, unless the Service has already been performed with the Client’s consent.

6.2. Customer cancellation

Cancellation - Blind Spot Program

6.2.1. The Blind Spot Program can only be canceled in writing via email and prior to the start. In such cases (without prejudice to the statutory withdrawal period), Wake Beyond Consciousness is entitled to retain the following fees:

a. At least 10 working days before appointment: 0%
b. Between 10 and 5 working days before appointment: 20%
c. 5 working days before appointment: 50%
d. Less than 5 working days before appointment: 100%

6.2.2. By canceling, the Client fully waives the report associated with this Service, regardless of the timing of cancellation.

6.2.3. If the Client does not show up without canceling, they will be given the option to reschedule. A fee of €20 for the reserved time will be charged and must be paid when booking the new appointment.

6.2.4. The €20 rescheduling fee as stated in 6.2.3 also applies if the appointment is:

a. Canceled or rescheduled within one hour before the appointment
b. Already rescheduled three times free of charge

Cancellation – Lasting Change Program

6.2.5. The Lasting Change Program can only be canceled in writing and before the start of the program. In such cases (without prejudice to the statutory withdrawal period), Wake Beyond Consciousness is entitled to charge or retain the following fees:

a. Within 14 days after purchase: 0% (unless already started, then pro rata)
b. After 14 days, but not yet started: 50%
c. All other cases: 100%

Exceptions may apply after consultation.

6.2.6. If payment is made in installments, the payment obligation remains if cancellation falls under clause 6.2.5 sub c. In case of cancellation under clause 6.2.5 sub b, a third installment will be canceled and the Client will receive an adjusted second installment.

6.2.7. Clauses 6.2.3 and 6.2.4 also apply to this Service.

6.2.8. To participate in this Service, the Client must have successfully completed the Blind Spot Program.

6.3. Seller cancellation:

Wake Beyond Consciousness may cancel a Service due to unforeseen circumstances (e.g., illness, unforeseeable circumstances). The Client will be informed as soon as possible and may be entitled to a (partial) refund or an alternative date

Article 7 - Liability

7.1. Wake Beyond Consciousness is not liable for damage or loss resulting from the use of its Services, except in cases of intent or gross negligence.

7.2. The Client is responsible for their own actions during and after participation in the Services.

7.3. Wake Beyond Consciousness is not liable for physical, psychological, or material damage unless directly caused by proven errors.

7.4. The Services do not replace medical or psychological treatment. Clients are advised to consult a qualified professional if needed.

7.5. Wake Beyond Consciousness is responsible for delivering the purchased Services but cannot be held liable for disappointing results, as outcomes depend on the Client’s effort and willingness.

7.6. Wake Beyond Consciousness is not liable for damages resulting from incomplete or incorrect information provided by or on behalf of the Client.

Article 8 - Privacy

8.1. Wake Beyond Consciousness processes personal data in accordance with the General Data Protection Regulation (GDPR). Data is only used for execution of the Agreement and related communication.

Article 9 - Intellectual Property

9.1. All materials, such as workbooks, presentations, or online content, remain the property of Wake Beyond Consciousness. The Client receives a personal, non-transferable right to use them for personal purposes within the Services.

9.2. It is not permitted to reproduce, distribute, or commercially use materials without written permission.

Artikel 10 - Unforeseeable circumstances

10.1. Wake Beyond Consciousness is not obliged to fulfill its obligations if prevented by unforeseeable circumstances, such as illness, natural disasters, technical failures, or other.

10.2. In such cases, the Client will be informed as soon as possible and a suitable solution will be sought, such as rescheduling the Service.

Artikel 11 - Complaints and Disputes

11.1. Complaints must be submitted in writing within 14 days after the Service via info@wakebeyondconsciousness.com. Wake Beyond Consciousness aims to resolve issues in mutual consultation.

11.2. These terms and all Agreements are governed by Dutch law.

Artikel 12 - Amendments

12.1. Wake Beyond Consciousness reserves the right to amend these terms and conditions. Updated terms will be published on www.wakebeyondconsciousness.com and apply to new Agreements.
